Architectural Enforcement
The Cimarron HOA is governed by the
CC&Rs which outline specific guidelines for living in the community. These guidelines include specific rules such as no parking of boats and RVs in the neighborhood plus general guidelines. It is the responsibility of the board to enforce the CC&Rs.
To enforce the CC&Rs, the board has a Director of Architectural Review who oversees weekly inspections plus quarterly
walk-throughs that all residents can participate in. Additionally, residents can report violations online using the
Cimarron eService system.
When a violation comes to the attention of the board, they will notify the resident verbally or in writing of the violation and provide for a period of correction (generally 10 - 30 days). If the problem is not corrected, the board may issue a
fine ranging from $25 to $250. If the issue is still not resolved, the board can issue an additional fine and/or abate the property by hiring a contractor to make the corrections. In the case of abatement, the resident will be responsible for any costs, fees, fines, etc.
Fines and abatement will always be a last resort for the board if it cannot get cooperation from the resident. As long as the resident follows up with the board and provides a reasonable plan for correcting the problem, the board will generally be accommodating.
